You agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Posh Sidekick By Poshmark Pro Tools grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use our service strictly under the terms of this Agreement.
These Terms and Conditions are a contract between you and Posh Sidekick By Poshmark Pro Tools, the Posh Sidekick By Poshmark Pro Tools website provider, and the services accessible from the Posh Sidekick by Poshmark Pro tools website.
You agree to be bound by these Terms & Conditions. If you do not agree to these T&C, please do not use the Service. If you violate any Terms and Conditions, we reserve the right to cancel your account or block access to your account without notice.
Users acknowledge and agree that by using the Service, they grant US a non-exclusive, worldwide, royalty-free, sublicensable, transferable right and license to use, reproduce, distribute, display, perform, and prepare derivative works of their User Content in connection with the Service and Company’s business, including without limitation for the purpose of promoting the Service or other Users’ products, and through “community sharing.”
Users acknowledge and agree that the Company may use their closet to advertise other closets and their items through “community sharing.” Users further acknowledge and agree that Company shall have the sole discretion to decide when these promotions will happen.
You agree to provide current, complete, and accurate purchase and account information for all purchases made at our app and/or website. You agree to promptly update your account and other information, including your email address and credit card numbers, and expiration dates so that we can complete your transactions and contact you as needed.
You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment methods in connection with any Purchase; and that (ii) the information you supply to us is true, correct, and complete.
We reserve the right to refuse any order you place with us.
We’ve updated our Terms & Conditions to provide you with complete transparency into what is being set when you visit our site and use our services. By purchasing any of Sidekick’s packages, you agree to allow Sidekick to access your account and perform shares on your behalf. You assume responsibility for providing access to your account using the provided password. Sidekick By Poshmark Protools is not responsible for any delays or disruptions in order completion due to revoke access, account status changes (blocks/bans/etc), Poshmark service interruptions, or other factors out of our control.
Sidekick By Poshmark Protools has no responsibility or any other factors that may affect the performance of your Poshmark business, such as your inventory characteristics, the number of items you have for sale, listing descriptions, and photos, etc. We are not responsible for any operations of your Poshmark business like sales, shipping, merchandising, etc.
By using the Poshsidekick and https://poshsidekick.com/ service (“Service”), Users agree to the
Terms, as well as this Amendment. Capitalized terms used but not defined in this Amendment have the meanings given to them in the Terms.
We run and monitor our systems 24 Hours per day, 7 days per week – all year round. Our developers are on hand to make sure any changes to the app or our systems are done promptly and professionally to cause the minimum of any downtime.
However, there are times out of our control that we may experience system interruption or downtime. We will endeavour to keep you updated during this time.
Compensation is awarded on a case by case basis. We are not obligated in any way to provide compensation for, but not limited to: Service maintenance, service down time, server and/or hardware failures that result in service interruption. Software or hardware upgrades that require service restarts and/or interruption in service.
Posh Sidekick reserves the right to deny compensation to any false claims of service interruption or claims of interruption that appear to be false as investigated by an employee of Posh Sidekick.
We will not require your billing information to sign up for a FREE TRIAL. Unless otherwise, you decided to upgrade and subscribe to our regular packages, then you will be required to input your billing information.
By providing us with your credit card number and associated payment information, you agree that we are authorized to verify information immediately. You agree to immediately notify us of any change in your billing address or the credit card used for the payment hereunder. We reserve the right at any time to change its prices and billing methods, either immediately upon posting on our site or through email.
If you register to any of our recurring payment plans, you agree to pay all fees or charges to your account for the Service in accordance with the fees, charges, and billing terms in effect at the time each fee or charge is due and payable.
No contract exists between you and us for the Service until we accept your order by a confirmatory e-mail. You are responsible for any third-party fees that you may incur when using the Service.
By utilizing the Sidekick by Poshmark Pro Tools (“Company”) mobile application (“Posh Sidekick App”), you hereby provide explicit consent to the inclusion of your account in the Company’s Promoted Listing service. This service entails the utilization of your account for the purpose of
promoting distinct shares, including content, information, products, services, or any other relevant materials (“Promoted Shares”) to other users exclusively within the confines of the Company’s posh sidekick network.
This consent confirms your understanding and agreement to this promotion method.
Posh Sidekick is designed to work optimally for closets with 5,000 or fewer listings. While the service may function for closets larger than 5,000 listings, we cannot guarantee full and comprehensive sharing coverage for closets exceeding this size.
We want you to be completely satisfied with our services. If you are not satisfied, please contact us at support@poshsidekick.com to discuss your concerns. If we are unable to resolve the issue to your satisfaction, you may be eligible for a refund under the following conditions:
Please note that if you cancel your subscription before the end of your billing cycle, you will retain access to our service until the end of that billing cycle but you will not be charged for the next billing cycle. However, we do not offer prorated refunds for the remaining days of your current billing cycle.

Affiliates and referrals participants expressly agree not to engage in any exploitation, fraud, misuse or unauthorized withdrawals from our affiliate or referral program payment system. Any such prohibited activity shall result in immediate termination from the program and forfeiture of any accumulated earnings. WE reserve the right to pursue any legal remedies, including but not limited to claims for damages, injunctive relief and criminal prosecution. Participants acknowledge that any breach of this provision will cause irreparable harm to Company.
If Company discovers any fraudulent referrals or affiliates, it reserves the right to immediately cancel the affiliate account and demand a refund of any earnings from such fraudulent activity. Fraudulent referral activity includes but is not limited to: referrals from invalid sources, artificial inflation of referrals through unauthorized means, referrals from sources in violation of the program terms and conditions.
